Article 1, Section 8 of the United States Constitution
gives authors exclusive rights to their own works for a limited
time. Congress enacted the 1976 Copyright Act, which protects
"original works of authorship", including "literary works".
The term "literary works" has been held to include computer
software. Section 103 of the Copyright Act protects "compilations",
which are defined as works "formed by the collection and assembling
of pre-existing materials or of data that are selected, coordinated,
or arranged in such a way that the resulting work as a whole
constitutes an original work of authorship". The copyright
usually lasts for the life of the author plus 50 years.
The basic elements of a work are expression and originality.
For copyright purposes, the work is considered original if
it was independently created and not copied from others. Further,
originality does not require novelty, that is, a work will
not be denied copyright protection merely because it is similar
to a work previously produced by someone else. Copyright protection
does not extend to an idea or fact.
